Brodie Wood Fitness — Terms & Conditions

Last updated: 1 October 2026

These Terms & Conditions apply to services provided by Brodie Wood Fitness ("BWF", "we", "us" or "our"), ABN 58 248 199 745.

These Terms & Conditions apply to BWF Coaching, standalone personal training and other fitness or coaching services agreed between you and Brodie Wood Fitness.

By purchasing, booking, signing up for or participating in a BWF service, you agree to these Terms & Conditions.

1. BWF Services

Brodie Wood Fitness provides personalised fitness and coaching services.

BWF's primary service is BWF Coaching, which may include personalised exercise programming, program progression and adjustments, exercise demonstrations and coaching, progress tracking, regular check-ins, feedback and support, accountability and habit coaching, general nutrition guidance, access to BWF's coaching platform, and scheduled in-person personal training sessions where included in the coaching level selected.

BWF may also provide standalone personal training without online coaching, including one or more in-person sessions per week, or another individually agreed training arrangement.

Standalone personal training and custom service arrangements may not always be publicly advertised on the BWF website and may be arranged directly between BWF and the client.

The services included, frequency, price, payment arrangement and any other important conditions applying to your service will be communicated and agreed before purchase or commencement.

2. Starting BWF Coaching

When signing up for BWF Coaching, you may be asked to select your coaching level, authorise recurring payment, complete BWF's onboarding and pre-exercise screening process, and provide the information reasonably required to prepare and deliver your coaching.

Your first coaching period includes onboarding, review of your information and preparation of your initial coaching setup.

Following completion of your onboarding information, BWF will aim to prepare your initial coaching setup and access to the coaching platform as soon as reasonably practicable, normally within two business days.

Your coaching does not need to begin on a particular day of the week. You can join when you are ready and your coaching will progress from there.

For standalone personal training or another custom arrangement, the commencement process may differ and will be agreed directly between you and BWF.

3. Payments and Weekly Billing

BWF Coaching is generally provided as an ongoing weekly service unless another arrangement has been specifically agreed with you.

Your weekly coaching fee is the amount displayed and agreed to when you sign up.

Payments may be collected automatically through BWF's payment provider, currently GoCardless.

There is no minimum contract period unless a different arrangement has been expressly agreed with you.

Your BWF Coaching subscription continues weekly until cancelled.

You are responsible for ensuring that payment details associated with your account remain valid.

Standalone personal training or custom arrangements may be paid per session, weekly, on a recurring basis or through another arrangement agreed between you and BWF.

The applicable price and payment arrangement will be communicated before the service begins.

4. Cancelling BWF Coaching

You may cancel BWF Coaching at any time without a cancellation fee.

To cancel, contact BWF at brodie@brodiewoodfitness.com or use another cancellation method provided to you by BWF.

Cancellation normally takes effect at the end of the coaching period that has already been paid for.

You may continue using coaching services included in that paid period until it ends.

No new weekly coaching period will intentionally be charged after your cancellation has taken effect.

Because Direct Debit payments are processed through the banking system, a payment that has already been created or submitted for processing may not always be able to be stopped immediately.

If a payment is processed after you request cancellation and you believe it relates to a coaching period you did not intend to purchase, please contact BWF.

We will review the circumstances and work with you to provide a fair resolution, including a refund where appropriate.

Nothing in this section limits any rights or remedies you may have under the Australian Consumer Law.

5. In-Person Personal Training Sessions

This section applies to both in-person sessions included within BWF Coaching and standalone personal training sessions.

Where BWF Coaching includes one or more in-person sessions per week, those sessions form part of your overall coaching service.

Standalone personal training sessions may also be arranged separately without requiring participation in online coaching.

In-person sessions may be delivered at BWF's private training studio, a third-party gym or another location agreed between you and BWF.

A minimum of 24 hours' notice is required if you need to cancel or reschedule an in-person session.

Where at least 24 hours' notice is provided, BWF will make reasonable efforts to reschedule the session, subject to availability.

Where less than 24 hours' notice is provided, or you do not attend a booked session, BWF may treat that session as having been used.

BWF understands that unexpected circumstances happen and may waive this requirement where BWF considers it reasonable to do so.

Sessions included as part of weekly coaching are intended to be used during the relevant coaching period.

Rescheduled or unused sessions do not automatically accumulate indefinitely or carry over into future coaching periods unless agreed with BWF.

If BWF needs to cancel an in-person session, we will arrange an alternative session, credit or other reasonable solution.

6. Health Screening and Health Changes

BWF collects relevant health and exercise information to help provide safe and appropriately personalised coaching.

Before beginning training or coaching, you may be asked about matters including medical conditions, medications, injuries, pain or physical limitations, previous surgeries, exercise restrictions, exercise history, pregnancy where relevant, sleep, stress and recovery, smoking or alcohol use where relevant to coaching, and other factors that may affect your ability to exercise safely.

You agree to provide information that is accurate and complete to the best of your knowledge.

You must tell BWF if there is a significant change to your health, injuries, medications, symptoms or circumstances that may affect your training.

BWF may modify, pause or decline particular training activities where we reasonably believe this is necessary for your safety or where your needs fall outside our professional scope.

BWF may recommend that you obtain medical or other appropriate professional clearance before participating in certain activities.

7. Exercise Risk

Physical exercise involves inherent risks.

These may include fatigue, delayed-onset muscle soreness, strains, sprains, falls, aggravation of existing conditions and, in uncommon circumstances, more serious injury.

BWF will take reasonable care and skill when providing training and coaching services.

You are responsible for following reasonable coaching instructions, communicating pain, dizziness, unusual symptoms or significant discomfort, training within your capabilities, using equipment appropriately, providing accurate information about your health and circumstances, and stopping an activity and informing BWF where you believe continuing may be unsafe.

If you are uncertain whether exercise is appropriate for you, you should seek advice from an appropriately qualified health professional.

8. Online Training Responsibilities

Some BWF Coaching services are delivered remotely and may be completed without BWF physically present.

When completing training independently, you are responsible for selecting an appropriate and reasonably safe environment, making sure equipment is suitable and in safe working condition, following the program instructions provided, asking for clarification where you are unsure how an exercise should be performed, and informing BWF about injuries, symptoms or circumstances that may affect your program.

9. Professional Scope

BWF provides personal training, exercise programming, coaching and general health, fitness, lifestyle and nutrition education within the professional scope of a personal trainer.

BWF does not provide medical diagnosis or treatment.

BWF coaching is not a replacement for medical care, physiotherapy, psychology, dietetic treatment or another regulated health service where those services are required.

Nutrition support provided as part of BWF services is general nutrition education and guidance rather than medical nutrition therapy or treatment of medical conditions.

Where your needs fall outside BWF's professional scope, we may recommend that you obtain advice from an appropriately qualified professional.

10. Results

BWF cannot guarantee a particular physical, performance, bodyweight, health or other outcome.

Results vary between individuals and can be influenced by factors including training consistency, nutrition, recovery, health, sleep, stress, lifestyle, genetics and adherence to coaching.

Testimonials and examples of previous client results describe individual experiences and are not guarantees that another person will achieve the same result.

11. Failed or Overdue Payments

If a payment fails or becomes overdue, BWF may contact you and make reasonable attempts to resolve the payment.

BWF may pause coaching or training services where payment remains outstanding.

Where a failed payment is later successfully collected, services may resume.

BWF will deal reasonably with payment issues and encourages clients to contact us if they are experiencing a problem.

12. Refunds and Consumer Rights

BWF does not generally provide a refund simply because a client changes their mind about a coaching period or service that has already begun and for which services have been supplied or made available.

However, if you believe there has been an incorrect payment, a problem with your service or circumstances you would like BWF to consider, please contact us.

BWF may provide a refund, partial refund, credit or another resolution where appropriate.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, where that right cannot legally be excluded or restricted.

13. Changes to Coaching, Services or Pricing

BWF may improve or adjust the way services are delivered over time.

Any material change affecting an existing client's arrangement will be communicated where reasonably appropriate.

If BWF changes the recurring price applying to an existing ongoing coaching or training arrangement, reasonable notice will be provided before the new price takes effect.

If you do not wish to continue at the new price, you may cancel before the price change takes effect without a cancellation fee.

Changes will not retrospectively alter the price of a service period that has already been purchased.

14. Third-Party Services and Facilities

BWF uses third-party services to help operate and deliver its services.

These may include website services, payment processing, coaching applications, booking systems, email, analytics, cloud storage and communications platforms.

Examples may include Framer, Google services, GoCardless, Everfit, Cal.com, MailerLite and other providers used by BWF from time to time.

In-person training may also take place at a third-party gym or facility.

When using a third-party application, facility or service, you may also be subject to that provider's own terms, policies and rules.

BWF is not responsible for the independent operation of a third-party provider except to the extent responsibility cannot legally be excluded.

15. Behaviour and Safety

BWF aims to provide a safe, respectful and welcoming coaching environment.

BWF may refuse, pause or end a coaching or training relationship where a client engages in abusive, threatening, discriminatory, dangerous or seriously inappropriate behaviour.

BWF may also pause or end services where continuing presents an unreasonable safety risk, the client's needs fall outside BWF's professional scope, payment remains outstanding after reasonable attempts to resolve it, or circumstances make it unreasonable for the relationship to continue.

Where BWF ends an ongoing prepaid service, any unused services will be dealt with reasonably and in accordance with applicable law.

16. Personal Property

You are responsible for your personal belongings while attending in-person training.

BWF is not responsible for loss, theft or damage to personal property except where responsibility cannot legally be excluded.

17. BWF Programs and Content

Programs, educational materials, exercise resources, written content, videos and other BWF materials are provided for your personal use as part of your training or coaching.

They must not be reproduced, resold, distributed or commercially used without permission from BWF.

18. Privacy

BWF collects, uses and protects personal and health information in accordance with the Brodie Wood Fitness Privacy Policy and applicable Australian privacy law.

The Privacy Policy is available at:

brodiewoodfitness.com/privacy

19. Changes to These Terms

BWF may update these Terms & Conditions where its services, business practices or legal requirements change.

The current version will be published on the BWF website and will show the date it was last updated.

Where a material change affects an existing ongoing coaching or training arrangement, BWF will communicate that change where reasonably appropriate.

20. Governing Law

These Terms & Conditions are governed by the laws applicable in South Australia and the Commonwealth of Australia.
